Commission Contract

This Agreement, to be read in conjunction with the ‘Proposed Artwork Commission’ form is made between the Artist and the Art Collector as follows: 

  1. The Artwork: The Art Collector,  is commissioning the Artist, Derrick Bell to paint an abstract painting on canvas.
  2. The Concept: The Artist will paint an original painting on canvas
  3. Progress Report: The Artist agrees to furnish the Art Collector with progress reports during the creation of the work, which can include pictures of the work in progress. The pictures may be digital images and sent by email.
  4. Payment Amount: The price will be decided by the Art Collector and the Artist beforehand and be based upon canvas size and complexity of the completed work and will be consistent with other comparable works by the Artist at the time of sale. Painting size will be mutually determined by the Artist and the Art Collector. The Art Collector will pay the shipping costs of artwork from Orange County, California to the country of destination including tracking, insurance and destination taxes.
  5. Payment Schedule: A non-refundable deposit of 50% of the total to cover the Artist’s initial material costs is required before commencement of artwork. The remaining balance of payment is due upon completion of the work prior to shipping.
  6. Copyright: The Artist retains the copyright to all works commissioned by the Art Collector that were created by the Artist, including all reproduction rights and the right to claim statutory copyright. No artwork may be reproduced or altered without the written consent of the Artist.
  7. Right of Refusal: In the event that the Art Collector does not wish to purchase the commissioned artwork, the Art Collector may refuse. In that case, the Artist will retain the refused artwork and the non-refundable deposit. This is free of any claims or interests of the Art Collector and the Art Collector will not owe any additional fees to the Artist.
